Equitable division is required in Kentucky

A high-conflict divorce is one that can lead to a lot of emotional turmoil. You need to prepare for the mental challenges that are going to come during the process. We understand that it might not be easy to think about what’s happening, but you need to know what you’re up against ahead of time.

There are two common factors that are the focal points of the conflicts in these cases. One of these is the property division process, which is when you split up assets and debts. Many people think that everything is divided equally when you divorce; however, this isn’t the case in Kentucky. This state uses equitable division as the required standard.

When things are equitably divided, the split is based on what is fair, not what is equal. This is hard for some individuals to understand because they assume that they should get the exact same thing as their ex. By dividing things up equitably, you and your ex have some leeway in who gets what.

Because property division is such as contentious area, it is best to go through the possible divisions ahead of time and think about how each might impact your financial future. One thing to remember is that you might not always get exactly what you want.

The other area that is often difficult is child custody. Unfortunately, this isn’t likely to be resolved easily in situations in which both parents want to have an active role in the child’s life. It might be necessary to call in people who can evaluate the situation and help you make decisions for the children.

No matter what terms you work out with your ex, you need to have the terms in writing. Your divorce documents should contain everything you agreed upon during this process.
